PROSECUTORS’ ADVANCED TRAINING AND PUBLIC OFFICIALS OF THE PROSECUTOR’S OFFICE
The organization of advanced training of prosecutors in the National Academy of Public Prosecutors’ Office of Ukraine is held according to the Law of Ukraine “On Prosecution”, orders of the Prosecutor General of Ukraine and the Regulation on the common system of advanced training of prosecutors. Training of prosecutors at the National Academy of Public Prosecutors’ Office of Ukraine is held internal and external at least once every five years. Advanced training for prosecutors is held on the principles: Obligation; Continuity; Connection of theory and practice; Consistency and continuity; Differentiation; Level system.
Studying process is based on scientific principles, humanism, democracy, consistency, relevance, innovation, continuity and independence from interference of any political parties and other civic and religious organizations. Education is held in the official language. Teaching process is organized taking into consideration modern educational technologies and focuses on the formation of an educated, harmoniously developed personality capable of continuous updating of scientific knowledge and professional mobility.
Formation of a contingent of students and curriculum at organizing the training of prosecutors is held using the approaches of individualization and differentiation. Distance learning is used for training prosecutors of local prosecutor’s offices. Students who get external education, receive educational materials on the official website of the National Academy of Public Prosecutors’ Office of Ukraine, via email, participate in video conferences and consultations with employees of the National Academy of Public Prosecutors’ Office of Ukraine. Duration of training at the National Academy of Public Prosecutors’ Office of Ukraine is set according to the category of listeners. Curriculums are created in the National Academy of Public Prosecutors’ Office of Ukraine on the proposals of independent structural units of the Prosecutor General of Ukraine, state and local prosecutors’ offices. When creating curriculums such aspects as the practical needs of prosecutors activities, achievements of modern legal science and positive experience are taken into account.
Participation in the organization of educational process is given to Deputies of Prosecutor General of Ukraine, heads of independent structural units of the Prosecutor General of Ukraine, heads and deputy heads of regional and local prosecutors’ offices who submit proposals on forming curriculums for training of prosecutors, giving lectures to the audience, provide seminars, workshops, round tables and more. Over the last five years of the National Academy of Public Prosecutors’ Office of Ukraine 8776 Prosecutors (including 3455 – of external education) have had advanced training.
In the period from March to May 2016 in the National Academy of Public Prosecutors’ Office of Ukraine the heads, first deputies and deputy heads of local prosecutors’ offices were offered six-day training courses within a two-week advanced training, held with the support of the Council of Europe “Further support for criminal justice reform in Ukraine” and European Union “Supporting reforms in the justice sector in Ukraine” advisory mission of EU civil on security sector reform in Ukraine and the US Embassy. Advanced training was held in accordance with educational training had following topics: “The procedural administration of pre-trial investigation according to Council of Europe standards”, “Maintenance of public prosecution in court. Agreement in criminal proceedings”,”Management tools and decision-making”,”Personnel management, development of personal qualities, “Prosecutorial authorities and agencies to ensure the Prosecutors’ office activities, “Effective communication in the prosecutor’s office to improve confidence in the criminal justice system”, “Professional ethics of prosecutor, combating corruption among prosecutors.”
Since January 2017 the National Academy of Public Prosecutors’ Office of Ukraine trained individuals who have been tested for the positions in the local prosecutor’s office as part of training individuals who successfully tested the positions in the local prosecutor’s office. The main objective of education is to prepare individuals to work independently as a prosecutor of the local prosecutor’s office. To reach this, classes will be held in all areas of prosecution activities. At the practical and training sessions there will be considered all aspects of the administrating of procedural pre-trial investigation; maintaining by public prosecutor public prosecution; procedural administrating by prosecutor of holding secret investigative (detective) actions; prosecutor’s supervision of the following of laws in the execution of judicial decisions in criminal cases, the prosecutor representation of interests of citizens or state court. Also, much attention will be focused on the organization of work and management in the Prosecutor’s Office of Ukraine, professional ethics, psychology of prosecutorial activities.
During the training the trainees will be able to master the skills of drafting procedural documents of the Unified Register of pre-trial investigations. Experienced prosecutors, judges, representatives of public organizations will take part in training. The question of the implementation of European Court of Human Rights in prosecutorial activity will be discussed during the training, which involves the Council of Europe experts, the Advisory Mission of the European Union and the UN. To review the procedural administrative features pre-trial investigation in the criminal proceedings against cybercrime project manager of Ukrainian Interbank Payment Systems Member Association “EMA” will be involved. Representatives of the public organization “La Strada – Ukraine” will take part in exercises to combat gender-motivated violence.
In connection with the renewal of civil service legislation and the reform of the prosecution Ukraine, to enhance the professional competence there was established advanced training of civil servants and prosecutors. Since June 2016, the National Academy of Public Prosecutors’ Office of Ukraine trained 332 civil servants.
